General terms and conditions

Scope

• These general terms and conditions apply to all contracts concluded between guests and Hotel Mondschein for accommodation, meals and all related services.
• Unless expressly stated otherwise in these terms, the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) apply in their current version.

Conclusion of contract

• An accommodation contract is concluded with the reservation (in writing, electronically or verbally) and its subsequent confirmation by the hotel.

Payment terms

• The hotel is entitled to request a deposit when the contract is concluded.
• If no deposit has been agreed, the full invoice amount is payable at check-out.

Hotel's right of withdrawal

• The hotel is entitled to withdraw from the contract in the following cases:
• if performance of the contract becomes impossible or unreasonable due to force majeure or other circumstances beyond the hotel's control (for example natural disasters, pandemics, official measures, significant operational disruption);
• if technical or digital failures occur that significantly impair proper performance of the contract (for example cyber attacks, prolonged system or network outages, serious errors in the booking systems);
• if the hotel has reasonable grounds to suspect that use of the service could endanger the smooth running of the business, the safety or the reputation of the hotel;
• if the guest fails to pay the agreed deposit despite a reminder.
• In all of these cases the guest will be informed of the withdrawal without delay. Payments already made will be refunded in full; any further claims by the guest are excluded.
• Otherwise the cancellation rules of the AGBH 2006 apply.

House rules

• To ensure a smooth and pleasant stay, the following house rules apply:
• Listening to or playing music in or near the rooms is not permitted.
• Smoking is prohibited in all enclosed spaces and in the immediate vicinity of the guest rooms.
• Pets are allowed only in selected rooms and only by prior reservation.
• For damage to the building, furniture, textiles or other fittings during the stay (for example wine or burn marks, scratches), we reserve the right to charge the guest the corresponding costs.
• The hotel reserves the right to refuse guests or to end their stay early if the house rules or generally accepted rules of conduct are breached.

Liability

• The hotel is liable for items brought onto the premises in accordance with the statutory provisions (§§ 970 ff. of the Austrian Civil Code, ABGB) up to an amount of €1,100.
• The hotel is only liable for valuables, cash and precious items if they have been expressly accepted for safekeeping against a receipt or deposited in the hotel safe.
• The hotel is liable only within the statutory provisions for damage demonstrably caused by gross negligence or intent. Any further liability, in particular for slight negligence, is excluded.
• The hotel accepts no responsibility for injuries occurring inside or outside our premises during the stay or on the way across our grounds, unless mandatory statutory liability provisions apply.
• Likewise, no liability is accepted for incidents during excursions or activities outside the house.

Final provisions

• By booking, the guest expressly accepts these terms and conditions.
• Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.
• Austrian law applies exclusively. The place of jurisdiction is the competent court at the hotel's registered office.

Cancellation terms

The same cancellation terms apply to all three houses (Ski Hotel Mondschein, Mondschein Chalet and Arlberg Motel):

• Up to 3 months before arrival: no cancellation fee
• From 3 months before arrival: 40 % of the total amount
• From 1 month before arrival: 70 % of the total amount
• From 1 week before arrival: 100 % of the total amount
• For no-show or early departure, the full amount of the booked stay will be charged.
• The promotional rates Last Minute Escape and Stay 5 Pay 4 are an exception: they are non-refundable, and the full amount is charged for cancellation or no-show.
