General Terms and Conditions (GTC)

1. Scope of Application

• These General Terms and Conditions (GTC) apply to all contracts concluded between guests and Hotel Mondschein regarding accommodation, meals, and all related services.
  Unless otherwise expressly provided in these GTC, the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) in their applicable version shall apply.

2. Conclusion of Contract

• A binding accommodation contract is formed upon reservation (in writing, electronically, or verbally) and subsequent confirmation by the hotel.

3. Payment Terms

• The hotel is entitled to request a deposit at the time of booking.
  Unless a deposit has been agreed, the total invoice amount is payable upon check-out.

4. Hotel’s Right of Withdrawal

The hotel is entitled to withdraw from the contract in the following cases:

• if fulfillment of the contract becomes impossible or unreasonable due to force majeure or other circumstances beyond the hotel’s control (e.g. natural disasters, pandemics, official measures, significant operational disruptions);
• if technical or digital failures occur that significantly impair proper performance of the contract (e.g. cyber-attacks, long-term system or network outages, major errors in booking systems);
• if the hotel has reasonable grounds to suspect that the use of its services may endanger smooth business operations, safety, or the reputation of the hotel;
• if the guest fails to make the agreed deposit despite a reminder.

In all such cases, the withdrawal will be communicated to the guest without delay. Any payments already made will be fully refunded; further claims by the guest are excluded.
In all other respects, the cancellation provisions of the AGBH 2006 shall apply.

5. House Rules

• To ensure a smooth and pleasant stay, the following house rules apply:

• Playing or listening to music in the rooms or in their vicinity is not permitted.

• Smoking is strictly prohibited in all indoor areas and in the immediate vicinity of guest rooms.

• Pets are permitted only in selected rooms and must be reserved in advance.

• Guests are liable for any damage caused to the building, furniture, textiles, or other facilities during their stay (e.g. wine or burn stains, scratches). The hotel reserves the right to charge the guest for the respective costs.

• The hotel reserves the right to refuse accommodation or to terminate a stay if guests violate the house rules or generally accepted standards of conduct.

6. Liability

• The hotel is liable for items brought in by guests in accordance with statutory provisions (§§ 970 et seq. ABGB) up to an amount of € 1,100.

• Liability for valuables, cash, and jewelry is only accepted if such items have been expressly handed over for safekeeping against receipt or deposited in the hotel safe.

• The hotel is liable only within the scope of statutory provisions for damages demonstrably caused by gross negligence or intent. Any further liability – in particular for slight negligence – is excluded.

• The hotel assumes no responsibility for injuries occurring inside or outside the premises during the stay or while passing through the grounds, unless mandatory statutory liability provisions apply.

• Likewise, the hotel accepts no liability for incidents during excursions or activities outside the property.

7. Final Provisions

• By making a booking, the guest expressly acknowledges these GTC.
• Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
• Exclusively Austrian law applies. The place of jurisdiction shall be the competent court at the registered seat of the hotel.

Cancellation Policy

• The cancellation policy is based on the official guidelines of the Austrian Hotel Association (WKO):
• Up to 3 months before arrival – no cancellation fee
• Up to 1 month before arrival – 40% of the total amount
• Up to 1 week before arrival – 70% of the total amount
• Less than 1 week before arrival – 90% of the total amount
• In case of a late cancellation, no-show, or early departure, the full amount of the booked stay will be charged.
